Don't Let a Stranger's Debt Become Your Nightmare. A trade veteran's guide to HP, PCP and stocking loans — and the red flags that expose them.
The V5C proves who keeps the car — not who owns it.
Most buyers think the V5C logbook is proof of ownership. It isn't. The V5C only records the registered keeper — the person responsible for the car day to day. The legal owner can be someone else entirely: a finance company holding a Hire Purchase or PCP agreement, or a trade lender holding a stocking loan on a dealer's forecourt.
That gap is where hidden finance lives. In the UK, a huge share of used cars are bought on HP or PCP, and while any balance remains, the lender — not the seller — owns the vehicle. Buy one of those cars privately with outstanding debt attached and the finance company can lawfully seize it from you, even though you paid good money and knew nothing about the agreement. You lose the car, and chasing the seller for a refund is usually a lost cause.
I've watched these signs play out over 30 years in the trade. Spot one, and the car goes back on the driveway — no exceptions.
A seller who says the finance will be settled “next week”, “after the sale” or “from the money you give me” is asking you to fund their debt. A lender legally owns the car until the final payment clears — if the seller never settles, the finance company can repossess it from your driveway, and you lose the car and the cash.
No V5C, a V5C registered to someone else, or a settlement letter that “is at the bank”. Legitimate sellers can produce the logbook and a written settlement figure from their lender on the spot. Vague answers about who holds the agreement are how repossessed cars end up in innocent buyers' hands.
A car priced thousands below market value is often a distressed sale — someone raising cash fast because they can't keep up the payments, or a trader quietly moving on financed stock. Desperation isn't a bargain; it's a warning that debt is attached to the metal.
